Agreement Terms
Section 1. What is Locumize?
Locumize is a technology marketplace that connects healthcare facilities directly with licensed physicians for locum tenens work. We are not a staffing agency — we provide the platform that lets you find, vet, and engage physicians on your own terms. All work arrangements are made directly between your facility and the physician.
Section 2. Subscription & billing
All billing via Stripe — subscriptions, escrow, payment release & 1099s
Platform access requires a monthly subscription billed via Stripe — no long-term contract. Your plan includes position postings, physician search, timesheets, contract management, and payment processing. Fees are non-refundable for the current billing period. To cancel, provide 30 days written notice before your next billing date.
Section 3. Physician payments & Stripe escrow
When an assignment is confirmed, payment is held in Stripe escrow until the physician submits a timesheet and you approve it. Funds release upon your approval. Locumize does not hold or access these funds. Your facility must ensure funds are available and review and approve or dispute timesheets promptly; we encourage you to approve and release payment within 72 hours of submission. Funds are released to the physician only when you approve the timesheet. Stripe also generates year-end 1099s for all payments.
Section 4. Facility obligations
You agree to: (1) Provide accurate facility info including licensure and insurance. (2) Post positions truthfully — correct specialty, shift type, rate, and location. (3) Communicate promptly and professionally with physicians. (4) Review and approve or dispute timesheets promptly; we encourage approval and payment release within 72 hours of submission (funds release only when you approve). (5) Arrange malpractice coverage for each assignment as agreed with the physician and specified in the assignment contract (Locumize does not mandate or provide coverage). (6) Comply with all applicable federal, state, and local healthcare staffing regulations.
Section 5. Liability insurance for physicians
Professional liability (malpractice) coverage for each assignment is determined by agreement between the physician and the facility and specified in the assignment contract. Locumize does not require either party to carry coverage and does not provide malpractice insurance.
Section 6. Contract management
Locumize provides built-in contract tools. You may: (1) Generate assignment agreements directly on the platform using standard templates. (2) Sign agreements electronically within the platform. (3) Upload externally sourced or custom contracts for record-keeping. All executed agreements are stored and accessible to both parties.
Section 7. Verification via Provider Trust
Verification is handled by Provider Trust. No action required from your facility unless additional info is requested.
Physician verification is handled by Provider Trust, an independent third-party service. When a physician is matched with your facility, Locumize initiates verification covering license verification, board certifications, DEA registration, work history, malpractice history, and OIG/SAM exclusion checks. No assignment may begin until verification is complete.
Section 8. Assignment cancellation policy
Cancellation terms for each assignment are set by the facility and specified in the assignment contract. Any cancellation penalty agreed between the facility and the physician is processed through Stripe. Locumize does not set or impose cancellation penalties.
Section 9. Privacy & data
Locumize processes your facility information to operate the platform. Physician data shared with your facility may only be used for evaluating and engaging that physician through Locumize — not for any outside purpose without their consent. If your facility handles patient health information, you remain solely responsible for HIPAA compliance.
Section 10. Limitation of liability
Locumize is not responsible for physician clinical performance, patient outcomes, payment disputes arising from timesheet disagreements, or issues arising from the physician-facility relationship. To the fullest extent permitted by law, Locumize shall have no liability for any claim arising out of or relating to this Agreement or your use of the platform.
Section 11. Termination
The facility may terminate this Agreement by providing 30 days' written notice. Locumize may suspend or terminate your account at any time, with or without prior notice, including for unpaid fees, breach of these terms or our Terms of Service, misrepresentation, conduct that harms the platform or its users, or to comply with legal or regulatory requirements. Active assignment obligations and any applicable cancellation penalties remain in effect upon termination.
Section 12. Governing law
This agreement is governed by the laws of the State of Texas. Unresolved disputes go through a 30-day negotiation period, then binding individual arbitration under AAA rules. Class action lawsuits are not permitted.
